Terms of Service

Last updated October 27, 2026

These Terms of Service ("Terms") are an agreement between you and Synergia Solutions Holding Ltd., a British Columbia company ("Pingerer", "we", "us"), of 502 Smith Avenue, Coquitlam, BC V3J 0H9, Canada, for your use of the Pingerer website, apps, API, command-line tool and related services (the "Service"). By creating an account or using the Service you agree to these Terms. If you use the Service for a business, you agree on its behalf and confirm you're allowed to.

1. Your account

  • You must be at least 16 years old, or the age of digital consent where you live, and give us accurate information.
  • You're responsible for everything done through your account and its API tokens, and for keeping your password and tokens safe. Tell us right away at support@pingerer.com if you think someone else has access.
  • An account can have several members. The account's owner decides who has access and what they can do, and is responsible for them.

2. What you may monitor

You may only monitor websites, servers, domains and services that you own or are authorized to monitor. Your use must follow our Acceptable Use Policy, which is part of these Terms. We may refuse, pause or remove any check that we reasonably believe breaks it.

3. The Service

  • Pingerer checks the targets you set up from our servers and tells you what we find. Checks can fail or be delayed because of the internet, third parties (such as DNS resolvers, domain registries, SMS carriers and messaging platforms) or our own systems. We work hard to make alerts reliable, but we can't promise that every problem will be detected or every alert delivered.
  • Pingerer is a tool to help you notice problems. It is not a guarantee that your site or service will work, and it isn't a substitute for your own backups, security measures or professional advice.
  • We may change, add or remove features. If we remove something significant that you pay for, we'll tell you in advance.
  • Our iPhone and Android apps are free companions to your Pingerer account. If you get them from the App Store or Google Play, those stores' terms apply too; Apple and Google aren't parties to these Terms and aren't responsible for the apps or the Service.

4. Plans, payment and cancellation

  • The free plan is free with the limits shown on our pricing page. Paid plans are priced by the number of domains you monitor, as shown there, and billed in advance, monthly or yearly, through our payment processor, Stripe. If you add or remove domains, your bill changes from your next billing date. Prices don't include taxes unless we say so.
  • Paid plans renew automatically until cancelled. You can cancel anytime from the Billing page; your plan stays active until the end of the period you've paid for and then moves to the free plan.
  • SMS packs are one-time purchases. Unused texts don't expire while your account is open, but they aren't refundable or transferable.
  • We may change prices. Price cuts apply to you automatically. For an increase we'll give at least 30 days' notice by email, and the new price applies from your next renewal after the notice period. If we've promised you a price (for example as a founding member), we keep it for as long as your paid plan stays active.
  • Except where the law requires otherwise, payments are non-refundable. If something went wrong, contact us and we'll look at it fairly.
  • If a payment fails, we may limit or pause your paid features until it's resolved.

5. Your content and data

  • You keep all rights to the information you put into Pingerer (such as URLs, settings, status page content and contact details) and to the results we gather about your targets ("Your Data").
  • You give us permission to store, process and display Your Data as needed to provide, secure and improve the Service, as described in our Privacy Policy and, for business customers, our Data Processing Addendum.
  • You also give us permission to keep monitoring results indefinitely, including after your account closes (then only in a form that no longer identifies you or your account), and to combine them with other customers' results, anonymized, to produce and publish statistics and research. We never sell or share data that identifies you, your account, your sites or your clients.
  • Content you publish on a public status page is visible to anyone. You're responsible for what you publish there.
  • You can export Your Data at any time, and ask us to delete it and close your account. Deleted sites and accounts are archived first; we review deletion requests and remove your personal information within 30 days.

6. Alerts to other people

If you add someone else's email address, phone number or chat channel to receive alerts, you confirm they've agreed to get them. Text messages are covered by our SMS Terms.

7. Fair use and limits

Each plan has limits (such as domains, check intervals and SMS credits). The free plan is for genuine personal and small-business use; we may limit accounts that appear to be created to get around plan limits. We may set reasonable technical limits, such as API rate limits, to keep the Service working for everyone.

8. Suspension and termination

You can stop using the Service and ask us to delete your account at any time. We may suspend or close an account, with notice where reasonable, if it breaks these Terms or the Acceptable Use Policy, puts the Service or others at risk, or hasn't paid. Where we can, we'll let you export Your Data first.

9. Our intellectual property

The Service, including its software, design and the Pingerer name and logo, belongs to us or our licensors. These Terms don't give you any right to them except to use the Service as intended. If you send us feedback, we may use it without owing you anything.

10. Disclaimers

To the fullest extent the law allows, the Service is provided "as is" and "as available", without warranties of any kind, including merchantability, fitness for a particular purpose and non-infringement. We don't warrant that the Service will be uninterrupted, error-free or detect every outage.

11. Limitation of liability

To the fullest extent the law allows: (a) we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, including losses caused by an outage that the Service did not detect or report; and (b) our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and US$100. Some places don't allow these limits, so they may not all apply to you.

12. Indemnity

If you use the Service for a business, you'll defend and compensate us for claims by third parties arising from your use of the Service in breach of these Terms or the Acceptable Use Policy, including monitoring targets you weren't authorized to monitor.

13. Changes to these Terms

We may update these Terms. For material changes we'll give at least 30 days' notice by email or in the app. If you keep using the Service after the change takes effect, you accept the new Terms; if you don't agree, you can close your account.

14. Governing law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there, and disputes will be resolved in the courts of British Columbia, sitting in Vancouver, except where consumer law where you live gives you the right to bring claims locally.
